1. Eligibility

You must be at least 13 years old to use the Service and at least 18 to submit or claim a business listing. By using the Service, you represent that you meet these requirements and that all information you provide is accurate.

2. Your account

• You are responsible for your account credentials and all activity under your account.
• One person per account. Do not impersonate others or misrepresent affiliations.
• Notify us immediately of unauthorized use of your account.

3. What you can do on FoodLakayNJ

Subject to these Terms and our other policies, you may:

• Create an account and customize your profile, including a profile photo.
• Upload photos and videos.
• Post in the community feed and comment on content.
• Save content for later and follow businesses.
• Receive notifications about activity you've opted into.
• Submit business listings and, if eligible, claim a business listing.

4. User-generated content ("UGC")

You retain ownership of the content you create and submit ("Your Content"). By submitting Your Content to the Service, you grant FoodLakayNJ a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, modify (e.g., format and resize), publish, publicly display, distribute, and use Your Content in connection with operating, promoting, and improving the Service. This license ends when you remove Your Content, except (a) to the extent it was shared with others who retained it, and (b) for backups and legal compliance.

You represent and warrant that:

• You own Your Content or have all necessary rights to grant the license above.
• Your Content does not infringe any third-party rights or violate any law.
• Reviews and posts reflect your honest experience and are not paid or deceptive.

5. Acceptable use

You agree not to:

• Post content that is unlawful, harassing, hateful, threatening, sexually explicit, or that exploits minors.
• Post spam, scams, misleading reviews, or content that infringes intellectual property rights.
• Impersonate any person or business, or falsely claim ownership of a listing.
• Interfere with the Service, scrape it without permission, or attempt to bypass security or rate limits.
• Use the Service to collect data about other users for unauthorized purposes.

6. Business listings & claims

• Anyone may submit a business listing for review. We may verify, edit, or decline submissions at our discretion.
• Claiming a listing requires verification of ownership. False claims may result in suspension.
• Listings are informational. We do not guarantee accuracy of hours, menus, prices, or availability — confirm directly with the business.

7. Moderation, suspension, and termination

We use a mix of automated and human moderation. Photos, videos, community-feed posts, and comments containing media may require approval before they appear. We may remove content, restrict features, suspend, or terminate accounts that violate these Terms or our policies, with or without notice. You may also delete your account at any time by contacting us.

8. Copyright (DMCA)

We respect intellectual property rights. To report copyright infringement, see our Copyright & DMCA Policy. Repeat infringers will have their accounts terminated.

9. Third-party content and links

The Service may display content, links, embeds (e.g., YouTube or TikTok videos), and information from third parties. We do not endorse and are not responsible for third-party content or websites.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT BUSINESS INFORMATION IS ACCURATE OR CURRENT.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FOODLAKAYNJ AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

12. Indemnification

You agree to defend, indemnify, and hold harmless FoodLakayNJ and its affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from Your Content, your use of the Service, or your violation of these Terms.

13. Governing law & disputes

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-laws principles. You and FoodLakayNJ agree to the exclusive jurisdiction of state and federal courts located in New Jersey for any dispute not subject to informal resolution.

14. Changes

We may update these Terms from time to time. Material changes will be highlighted on the Service. Continued use after the effective date constitutes acceptance.
