Copyright & DMCA Policy

FoodLakayNJ respects the intellectual property rights of others and expects users to do the same. We respond to clear notices of alleged copyright infringement under the U.S. Digital Millennium Copyright Act ("DMCA").
Reporting copyright infringement
If you believe material on FoodLakayNJ infringes your copyright, send a written notice to our designated agent that includes ALL of the following:
- A physical or electronic signature of the owner, or a person authorized to act on behalf of the owner, of the exclusive right that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed (or a representative list if multiple works).
- Identification of the material that is claimed to be infringing, and information reasonably sufficient to permit us to locate it (e.g., a direct URL on FoodLakayNJ).
- Your contact information: name, mailing address, telephone number, and email address.
- A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
Where to send notices
Send DMCA notices via our Contact Us page with the subject line "DMCA Notice." Notices missing required information may not be actionable.
What we do with a valid notice
- Remove or disable access to the allegedly infringing material.
- Notify the user who posted it and forward a copy of your notice (including your contact information).
- Track repeat infringers and terminate their accounts when appropriate.
Counter-notice
If you believe your content was removed in error or misidentified, you may submit a counter-notice including:
- Your physical or electronic signature.
- Identification of the material that was removed and its prior location (URL).
- A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
- Your name, mailing address, and telephone number, and a statement consenting to the jurisdiction of the federal district court for the judicial district where you reside (or, if outside the U.S., the District of New Jersey), and that you will accept service of process from the person who provided the original notice or their agent.
If we receive a valid counter-notice, we may restore the material in 10–14 business days unless the original complainant notifies us they have filed a court action.
Repeat infringer policy
Accounts that repeatedly infringe the copyrights of others will be suspended or terminated.
Misrepresentation
Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be liable for damages.
